The Client :
In this page, the term "Client","Customer" or "Affiliate" will refer to the company who owns the mailing list.
The Recipient :
In this page, the term "Recipient" or "Subscriber" will refer to the person receiving the email.
The Policy :
This policy defines "spam" as well as defines the steps that will be taken in the case CustomerNews servers will be found to be sending unsolicited email.
Spam is Unsolicited Commercial Email
The definition of "spam" is unsolicited commercial email, junk mail or bulk mail that has not been requested by the recipient. In addition to being perceived as intrusive, irrelevant and often offensive, it is also typical that spam emails do not contain an option to unsubscribe from the mailing list. Simply put, spam is the opposite of permission-based emails - those that are requested, anticipated, personal and relevant.
Preventing Unsolicited Emails from being sent by CustomerNews' servers
Any client wishing to work with us must abide by a strict Terms of Service. In our "Terms of Service", it clearly states in our policy with respect to spam: "A client may not use CustomerNews or ask CustomerNews to send unsolicited bulk email, for commercial or non-commercial purposes."
Also, clients must accept that an unsubscribe option will be automatically appended to every email sent via CustomerNews. This is not an option, it is a requirement as stated in the CAN-SPAM regulations and any emails being sent through CustomerNews's mailservers are built according to it. In the event that a client violated any of our usage rules, or for any other reason deemed appropriate by CustomerNews, CustomerNews reserves the right to suspend or terminate, without notice, any running campaign that belongs to the related client and remove all of his data.
Encouraging Permission-Based Marketing
CustomerNews requests from its clients to create and manage "opt-in" subscriber lists, as well as provide server logs of subscriptions dates and IP addresses used by the recipients. By building and using an "opt-in" subscriber list, clients can be certain that they are sending emails to recipients that have expressly given their permission to do so.
It is also important to note that subscribers receiving email campaigns by clients will only see their names in the header - all other email addresses are not viewable which makes them safer from unsolicited email abuse via other recipients of the same email campaign.
Responding to Unsolicited Email Complaints
If a complaint is received regarding unsolicited emails being sent from CustomerNews' mailservers, an immediate investigation is undertaken.
Initial Warning
The affiliate is first notified that an unsolicited email complaint has been lodged against them and:
(a) Reminded of the terms they accepted in the Terms of Service.
(b) Reminded that the recipient's email address will automatically be flagged for suppression if the recipient did unsubscribe.
(c) Requested to manually remove the recipient's email address from their subscriber list if the address was not automatically suppressed because the recipient did not unsubscribe.
Follow-up Warning
If the client persists, or if there are multiple complaints, a second warning is issued. The affiliate is contacted through the telephone and/or email address and is required to provide explanations and take care of the abuse complaints. Additionally, the affiliate is advised that if they are unable to abide by these terms, their CustomerNews' account will be immediately terminated.
CustomerNews can, by its own considerations, decide to end the agreement with a customer that is found to be sending out spam and terminate his account without any notice.
Termination Of Service
If notifications of unsolicited emails continue and remain unaddressed after the follow-up warning, or by CustomerNews' own considerations the affiliate's account privileges will be suspended and eventually terminated.
