The Client :
In this page, the term "Client" or "Customer" will refer to the company who owns the mailing list.
The Recipient :
In this page, the term "Recipient" or "Subscriber" will refer to the person receiving the email.
About this Document :
This document defines the terms a customer must agree with when deciding to use CustomerNews' services for delivering his email marketing campaigns.
Part one - Accept our policies
A customer interested in using CustomerNews' services must first read, understand and accept with all our following policies :
1. Opt-In Policy
2. Opt-Out Policy
3. Anti-Spam Policy
The customer must check his mailing list, the policies that were used when collecting his lists, the data collected when creating his lists and the quality of his lists. It is the client's responsibility to make sure he is following all of our policies when preparing to deliver us his mailing list.
Part two - Provide details
A customer deciding to work with CustomerNews must supply all of the following necessary information :
1. Customer's Name & Address
2. Customer's Contact Details (Phone number, Postal mailing address)
3. A copy of his identification card or driver's license
4. A Credit Card or Bank Account number with real details for verifying the real identity of the customer
All information provided must be real and accurate, and CustomerNews maintains the right to verify the details provided by the client in its solely discretion and rights.
Part three - Put an administrator incharge
A customer deciding to work with CustomerNews must provide the contact details of one person with technical and administrative knowledge who will be put as an administrator incharge of the mailings being sent out by the customer.
The client must agree that the administrator being put incharge will be allowed to be contacted by CustomerNews' server administrators anytime necessary to provide details about subscriptions, mailing list changes, bounces removals, abuse complaints, and to synchronize and maintain server databases or shutdown times if present.
Part four - Send an example campaign for verification
A customer deciding to work with CustomerNews must provide an example campaign that illustrates the type of mailings that will be sent through CustomerNews' servers for verification by the administrators.
It is CustomerNews' administrators right to deny or reject requests to cooperate from customers whos mailing campaigns do not comply with CustomerNews' policies.
Part five - Verification and Opening a Customer Account
Once a customer's details from Part two have been verified, an administrator was put incharge, and an example campaign have been approved by the CustomerNews' administrators, a customer account and database will be created for the customer to upload and maintain his mailing list and his mailing campaigns.
CustomerNews have the right to discretely monitor and follow the customer's actions to make sure he is operating legitimately and in accordance with these terms.
Part six - Miscellaneous and Security issues
CustomerNews servers operate through a list of unique IP addresses and use unique domains.
A client that will be found to be using CustomerNews' domains without their permission or without notifying them will be deleted immediately and without notice and legal actions will be taken against him.
A client may not use CustomerNews or ask CustomerNews to send unsolicited bulk email, for commercial or non-commercial purposes.
A client may not use CustomerNews' system for any other purpose other than that of sending permission-based email marketing campaigns, and is not allowed to upload a mailing list that is non confirmed opt-in or does not contain server logs or other proofs that the recipients agreed to be included in this list.
Part seven - Termination / End of service
A client may choose to end the business relationship with CustomerNews at anytime by sending a termination request, the termination request will be read and if found legitimate will be taken care of within 2-3 business days.
CustomerNews' maintain the right to end the business relationship with a client or terminate his services if found violating any of the above terms, or for any other reason we may find appropriate without any notice.
